The online store is the online sales outlet for the products and services of Jazeera Factory For Paints Co., Dubai branch, a Gulf company branch under the commercial registration number (1135822), on 04/28/2014, one of the branches of Jazeera Factory for Paints Co. registered in the Kingdom of Saudi Arabia and the owner of the trademark “Jazeera Paints”, hereinafter referred to as (the “Company”), including the company’s electronic application, together referred to as (the “Online Store”); by accessing the company’s website (the “Website”), the online store enables the company’s customers (“Customer”) to obtain the company’s information and products, as per the Terms and Conditions regulating the use, (“Terms and Conditions”) in addition to the regulations/laws of the United Arab Emirates (“State” and/or “UAE”) regulating such dealings ("Regulations" and/or "Laws"). The company reserves the right to make any amendments to the terms and conditions from time to time without prior notice to any party, and any amendments made to the laws shall apply to the Terms and Conditions and the online store. Therefore, the company recommends its valued customers to regularly check out these terms and conditions.
- Jazeera Paints, aims through the online store to provide its valued visitors with all the products and offers the company markets and sells. In addition, the online store displays the latest regarding our products and prices.
- The company is keen on displaying the color tones as accurately as possible; however, our valued customers are highly advised to consider that the displayed color tones may be different from reality due to different displaying screens and lighting setup.
All materials, texts, images, graphics, designs, models, files, multimedia, software, etc., included in the online store, are the property of the company, and the company reserves all intellectual property rights related to them, including copyright and distribution. It shall not allow the re-registration of all or parts of these materials, distribute, modify, nor use them for commercial, advertising, or personal purposes, nor re-publish them directly, or indirectly and in any way without prior explicit written consent by the company.
The customer may not be eligible to benefit from any of the services, products, and offers provided on the online store due to not meeting the Terms and Conditions, or for any other reason the company deems applicable; and the company reserves the right to reject any application submitted to it - without giving reasons - majorly in the following cases:
• Refusal / non-acceptance of the electronic payment process on the online store.
• In the event the delivery address given by the customer is wrong, or the contact information is wrong, or in the event, the company cannot reach the customer.
• In the event the product and/or service ordered is unavailable or out of stock.
- The online store user (customer) must register using correct, up-to-date, and complete information; and the customer is solely responsible for errors resulting from non-compliance with this term. The registration information shall include, but is not limited to, the full name, user’s address, email, credit card information, and other information required to complete the registration process on the online store. The registration on the online store shall be deemed the user’s (customer) consent and acceptance of the Terms and Conditions, and acceptance of the Replacement and Return Policy.
- The company reserves the right to reject any registration process on the online store according to its own evaluation and without giving reasons; in addition, the company reserves the right to carry out the necessary verification to ensure the validity of the information provided by the customer and its compliance with the registration requirements. As soon as the customer completes the registration, the validity of the registration continues for an unspecified period and remains subject to suspension or cancellation as per the Terms and Conditions.
- The customer is required to always make sure that the offers, prices, terms and conditions on the pages of the online store are still valid, as the company reserves the right to modify them at any time and without prior notice.
- The customer acknowledges that he shall bear full responsibility for all the obligations arising from using the online store and/or the website; and the customer acknowledges that he is aware and consents that the company shall not be held responsible for any technical errors or problems affecting the system on the website and/or the online store
– such as, but not limited to, pricing errors or specifying a required service; and the company reserves the right to cancel any service request, or correct it, whenever such error is discovered.
All personal data and information provided by the user will be treated with strict confidentiality; and the company will maintain the privacy of information as per the Privacy Policy on the online store at "Privacy Policy".
- The customer agrees and acknowledges that the company reserves the right to modify or cancel price categories and types of products and/or services, without prior notice, without any obligations from the company towards the customer; and the customer also acknowledges his responsibility to check the prices and types of products and/or services before placing an order or purchase.
- The company reserves the right to set the maximum or minimum quantity of products that can be purchased by each customer, or the amount paid for each purchase, according to the company's own discretion.
- The company is keen to provide its products and services at the best prices; however, sometimes the prices of products and/or services on the online store may differ from the prices of products and services in the company’s exhibitions.
- The customer acknowledges that he shall be held responsible for all the operations he performs through the online store, and the expenses incurred therefrom. The customer also acknowledges his responsibility to review the invoice for the services or products provided, and to check and verify its validity before placing the order; in the event of an error, the customer has the right to object to the company through the Customer Support described on the online store within a period not exceeding three (3) days from the date of receiving the products and/or the service.
- In case the customer makes a mistake in entering the information of the service request, he shall be able to modify the information through the online store using the same order number assigned to the first process, or through contacting the Customer Support to request correction of such information, within a period not exceeding twenty-four (24) hours from the time of placing the order.
- The company reserves the right to change the Terms and Conditions, or completely replace them with other new Terms and Conditions or replace a page or pages on the website without notifying the customer; the customer’s continuous logging in or use of the website shall be deemed as his acceptance and consent to the changes made to the online store.
- The company reserves the right to modify all or part of the design of the online store, or stop, or suspend the online store temporarily or permanently without prior notice at any time the company deems necessary; and the customer also agrees that the company shall not be liable to him or to any other parties for any modification, stopping, or suspension of the website.
The customer shall hold the sole responsibility for maintaining the confidentiality of his account and password of the registration on the online store, and agrees to bear full responsibility for all activities carried out through his account; thereof, the customer must inform the company immediately of any unauthorized use of his account or any other breach by a third party of the safety standards of use in the online store.
- The delivery period is from one (1) to three (3) working days, and the delivery cost value is 25 Emirate Durhams; the customer can benefit from free delivery if the value of the order is 300 Emirati Durhams or more. N.B. There may be changes in the duration or value of delivery, for that, we advise our valued customers to make sure of the delivery details on the cart page before paying.
- The company is keen to provide a pleasant and comfortable shopping experience for the customer. But in some cases, there may be some compelling difficulties beyond the company’s control that may cause a delay in the delivery of the order in due time, and the customer will be informed of any expected delays or difficulties that may have a big impact on the delivery of the ordered goods.
- All services that require the delivery of the product to the customer must be within the United Arab Emirates, and the customer can be reached easily.
- The company shall not be held liable for any risks related to the products (including the risk of loss or damage to the products) after they are delivered to the customer at the address indicated in the order.
- The company disclaims its responsibility to deliver or compensate the customer for the goods that expired due to the customer’s delay in receiving them (for cases where the reason for the delay was not due to the company) for a period of thirty (30) thirty days from the date of the purchase order; and in such cases, the company reserves the right to dispose those goods at the expense of the customer, and the customer shall be held liable for any damages incurred by the company due to this delay.
- The customer has the right to cancel the purchase order at any stage of the purchase, provided that it is in accordance with the following cancellation terms:
1. The cancellation request must be submitted before the products leave the company’s headquarters or any of its branches.
2. In the event when the customer is late for receiving the products for a period of fifteen (15) days from the date the order arrives at the customer’s address, the company has the right to cancel the order and return the purchase amount to the customer after deducting the product/products delivery value.
3. The customer has the right to cancel the purchase process without incurring cost in the event that the delivery was delayed more than 60 days from the date of the order bearing that the delay is not caused by the customer.
- The Terms of Termination and Cancellation of the purchase order shall not apply if the products were manufactured at the customer’s request or according to certain specifications the customer has stipulated, or in case the products were colored with coloring machines based on the customer’s prior request.
The interpretation and application of these Terms and Conditions is subject to the laws and regulations of the state, and any dispute arising between the two parties shall be referred to the competent dispute resolution authority in the state.
- The customer has the right to return or replace the products through an application to be submitted according to the form in place for this purpose on the company’s website, under the following conditions:
1. The replacement or return should be within the period indicated in the Replacement or Return Policy, with the exception of products proven to have defects or not conforming to the specifications agreed upon, or products that have been colored with coloring machines.
2. Returning or replacing a product stipulates that it mustn’t be used by the customer. Also, the product is in its original condition as it was at the time of purchase.
3. The products must be returned to the same exhibition stated in the purchase invoice. The company, with the consent of the customer, shall receive the products from the customer and return them after deducting the value of re-receipt from the customer.
4. In order to implement the return or replacement request, the customer must keep the purchase invoice for the relevant products to submit it when required.
- Time period for return or replacement of products:
Returning or replacing shall be made within thirty (30) days from the date of completing the purchase process.
The following cases shall be excluded from the return and replacement policy:
1. If the products are manufactured at the request of the customer or according to certain specifications the customer has stipulated – except for defects or non-conformity with the specifications agreed upon in the purchase invoice.
2. If a defect appears in the products as a result of poor storage by the customer.
3. If the products are colored with coloring machines.
1. The company shall automatically respond to requests of cancellation, replacement, and return within seventy-two (72) working hours.
2. The company shall not be held responsible for compensating the customer in case there is a delay in collecting the value of the returned products or the difference in value if the products are replaced with lower priced ones or for a reason/reasons other than by the company, for example, if the delay is caused by the bank the customer deals with.
3. The customer is not entitled to waive his rights of replacement and return under the Terms and Conditions herein to any other person.
The customer acknowledges that he has read and is aware of the contents of these Terms and Conditions and agrees to them in full without any exclusion, condition, or reservation.
